Terms and Conditions
- Definitions Companies may include Employers, Recruitment Consultancies, Employment Agencies and Advertising Agencies placing advertisements or using the service to fill vacanies directly or on behalf of their clients.
'You/Your' refers to individuals and/or entities accessing the Site.
"Client" shall mean the Company, firm or person who is the advertiser of the product or service promoted by the Advertisement and the purchaser of the CVGiant service.
The "Site" hsall mean the Internet Web Site known as CVGiant.
The "Advertisement" shall mean the advertisement to be published by CVGiant for the Client on the Site in accordance with these terms.
The "CV database" shall mean the information on potential candidates for jobs and job vacancies contained in CVGiant central database.
The "Applicant" shall mean the candidate seeking employment who has submitted their CV to the CV database for the purpose of finding employment.
- Client Obligations Clients undertake to take all reasonable precautions against the access to their personal login area on the Site by unauthorised persons including the use of user names and passwords and securing information relating to communications between you and CVGiant.
Clients must provide accurate and complete registration information, including an address to which invoices may be sent, and it is the Client's responsibility to inform CVGiant of any changes.
The Client should assume everything you see or read on the Site is copyrighted unless otherwise noted and may not be used except as provided in these Terms and Conditions without written permission from CVGiant. CVGiant neither warrents nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned by or affilated with CVGiant.
- Acknowledgements, Warranties and Representations You acknowledge that:
You are not vested with any proprietary right of the Site.
You will comply with the provisions of the Data Protection Act, 1998 and will do all that is necessary to enable CVGiant compliance therewith.
CVGiant does not vet or edit the contents of any advertisements submitted by Clients. The Client is responsible for ensuring that the content of the advertisement is not discriminatory, obscene, defamatory or otherwise illegal or in breach of any legistation in any jurisdiction.
- Advertisements Acceptability: CVGiant reserves the right in its absolute discretion to decline, cancel or remove any advertisement at any time without notice.
Liability: CVGiant does not accept any liability for error or delay or failure in publication of any advertisements or any consequences thereof.
Placing of Advertisements: The placing of and advertisement will be deemed as acceptance of CVGiant terms and conditions.
Response to Advertisements: CVGiant accepts no responsibility for the suitability of candidates who respond to advertisements.
- Database CVGiant shall provide the Client with access to a searchable on-line CV database during each period that the Client is actively using the Service as agreed and set out in the Schedule.
In the event that CVGiant has reason to believe or suspect that its CV database service is being abused in any way by the Client, CVGiant reserves the right to immediatly suspend or terminate the service.
CVGiant will only make available copies of the CVs which have been received from the Applicants, for distribution to agencies for the purpose of securing suitable employment, but makes no warranty whatsoever as to the availability or calibre of the candidates.
CVGiant cannot guarantee the minimum number of new CVs available on any CV service on any given day.
The Client shall:
Complete and sign the Schedule indicating which services it requires and return by fax or other specified method to CVGiant prior to commencement of the services.
Comply in all respects with all statutes, rules, regulations, codes of and legal requirements to which the Client is ordinarily subject in respect of its receipt and processing of CVs and related matters.
Use all CVs supplied by CVGiant for the sole purpose of endeavouring to locate suitable employment on behalf of Applicants.
Ensure that it is registered under the Data Protection Act 1998 to the extent that it applies and complies with its obligations under that Act.
Keep confidential the CVs and all other information supplied by CVGiant or Applicants to the Client or its employees or agents, and shall only use such information for the purpose of endeavouring to seek employment opportunities for Applicants with their express consent in respect of the CVs.
Obtain the express consent of an Applicant prior to submitting his or her CV to any client.
Not submit, copy, supply, re-sell, distribute or make available in any way and CVs or other information received from CVGiant to any person, business or company other than its genuine Clients who intend to recruit such Applicants for their own employment.
Not discriminate between CVs recieved CVGiant and those recieved directly in such a manner as to be prejudicial against Applicants whose CVs have been supplied by CVGiant nor discriminate between Applicants in endeavouring to secure employment and shall not engage in any illegal discriminatory practices whether by reason of race, sex or disability.
Indemnify and keep CVGiant fully and effectually indemnified against costs, claims, damages, loss, expenses and liabilities incurred by CVGiant arising out of the Client's use of information on CVs and any breach of its obligations under these Conditions and the Contract.
Ensure that no automatic extraction software (to include software tools commonly known as Robots and Spiders) or any other means, are engaged or deployed, either on a temporary or permanent basis, or unless specifically requested by the client and approved in writing by a Director of CVGiant, to facilitate the downloading or capturing of volume quantities of CVs from CVGiant.
Whilst CVGiant makes every attempt to remove viruses from the Word CVs it receives, we cannot guarantee that they are virus-free. Therefore you must ensure that you are running up-to-date virus checking software prior to downloading any file.
- Payment CVGiant will submit an invoice to the Client by fax or by post to the invoice address provided by the Client, for the services used by the Client. Unless returned as undelivered, a posted invoice will be deemed to have been received after two working days.
- Liability CVGiant does not verify or guarantee and candidate details. The Client shall satisfy itself as to the suitability of any candidate and shall take up references provided by any applicant before engaging such candidate. The Client shall be responsible for obtaining work and other permits, for the arrangements of medical examinations and /or investigations into the medical history of any applicant, and satisfy any medical and other requirements or qualifications required by law.
You acknowledge that the information and material available on or through the Site is for general information and use and is not necessary endorsed by us.
You acknowledge that we have no control over the information and material which can be accedded by or through the Site and that we do not know the nature of the information and material you or other users are sending, uploading or posting on the Site. We therefore exclude all liability of any kind (including the libel, breach of confidence, intellectual property right infringement, invasion of privacy, defamation and negligence) for the transmission or reception of such information or material of whatever nature by, about or to you.
You acknowledge that it is your decision to use the Site and, where applicable to (or not to) post, submit, remove or alter information or material on, to or from the Site. You agree that you do this at your own risk and that we shall have no liability for any loss or damages incurred by you or any other party as a result of you doing or failing to do the same.
You acknowledge that any agreements entered into by you and any third party as a result of or in connection with your or their use of the Site are made at your and their sole risk and responsibility. We do not vet other users of the Site and cannot vouch for their character, solvency or suitability for your purposes and accept no liability to you or them in connection with any aspect of your arrangements, dealings or agreements with them.
CVGiant is not responsible for the content of any off-site pages or any other sites linked to the Site. Linking to any other off-site pages or other sites is at your own risk.
While CVGiant uses reasonable efforts to include accurate and up to date information on the Site, CVGiant makes no warranties or representations for any errors of omissions in the content of the Site.
- Disclaimers CVGiant encourages discretion while browsing the Internet. The Site contains links to external sites and while such links are checked, we have no control over these sites or responsibility for them. We cannot therefore be responsible for any conent that some people may find offensive or inappropriate or which is inaccurate, misleading or in any other way unlawful.
For the same reason CVGiant cannot be responsible for information, materials, products or services on or available from external sites or any third parties you access through the Site, including payment for and delivery of inforamtion, materials, products, services and any other terms, conditions, warranties or representaions, associated with such dealings, are solely between you and the relevant third party. You agree not to hold us liable for any loss or damage of any kind incurred as the result of such dealings.
We are condident in the resilience of the Site, check its content and data for integrity on a regular basis and are confident in its performance. However we cannot give any warranty or other assurance regarding the information and materials available or the content, operations for the functionality of the Site or that the Site will meet your requirements or will be uninterrupted, secure or error or virus free.
Access to the Site may be interrupted, restricted or delayed. If for any reason the Site or our service to you is interrupted we will aim to restore our service as quickly as possible (to the extent that it is within our reasonable control to do so), although we shall be under no obligation to do so and shall not be liable in the event that we have not done so.
- Right To Revision CVGiant reserves the right to alter or remove the Site or any part of it and any information, material and facilities incorporating the Site, without any notice to you.
We reserve the right to terminate or suspend your access to or use of all or some areas of the Site without any notice to you and at any time.
CVGiant may at any time revise these Terms and Conditions by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.
The Client will have no right to compensation as a result of any removal, alteration, non-publication or termination under the Clauses above. We may, in our sole discretion, refund to the Client any part of payments already received in respect of any removed or non-published information or material.
We reserve the right to change these Terms and Conditions at any time. Such revised Terms and Conditions will be posted on the Site. By continued use of the Site after such Terms and Conditions have been posted, you agree to abide by such changes.
- TradeMarks The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Site are registered and unregistered Trademarks of CVGiant and others. Nothing contained on the Site should be construed as granting, by implication, or otherwise, any licence or right to use any Trademark displayed on the Site without the written permission of CVGiant or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited. CVGiant will aggressively ensure its intellectual property rights to the fullest extent of the law.
- Indemnity The client agrees to indemnify. CVGiant in respect of all and any claims whatsoever their nature, and in respect of all liabilities. CVGiant may incur arising from a Client's advertisement and in particular as a result of the following:
The publication of any defamatory allegations;
Any claims made by any person in respect of race, religion, sex, age, disability or discrimination.
CVGiant will send registered candidates very occasional emails with information on major site alterations and requests for updated details. Should you not wish to receive these emails please contact us at support@cvgiant.com
- Governing law and jurisdiction This agreement is governed by the laws of England and the parties irrevocably submit to the jurisdiction of its courts.
This should be read in conjunction with our Terms and Conditions.
- This site contains material in the form of Curriculum Vitaes submitted by candidates and we accept no responsibility for the accuracy or content.
- We may at any time without notification make changes to the service in order to comply with applicable regulatory or statutory requirements or Codes of Practise.
- We reserve the right to decline to publish and the right to remove any Advertisement accepted by us.
- Those third parties who advertise with us are wholly responsible for ensuring material submitted complies with all legal requirements. We do not accept liability for the availability, accuracy or existence of any jobs advertised.
- Any advertised links on the site leading to resources located on servers maintained by third parties are outside CVGiant Ltd’s control. We accept no responsibility or liability for any material contained on those servers.
- All liability is excluded to the extent permitted by law including any implied terms.
